Terms of Service

These Terms of Service (“Terms”) govern your use of Presence, a product of Sandhill Labs LLC (“we,” “us”). By using Presence, you agree to these Terms.

The service

Presence helps you manage your Google Business Profile, including drafting and publishing review replies and posts, maintaining profile information, and tracking local search performance. Features that read or write to Google are available only after you connect a Google account and grant the necessary permission.

Eligibility and authority

You must be at least 18 and authorized to manage the Google Business Profiles you connect. You represent that you are an owner or manager of those profiles, and that your use complies with Google’s terms and policies, which continue to apply to your Business Profile.

Your responsibility for published content

Presence generates drafts with AI. Drafts can contain errors. You are responsible for reviewing content before it is published to your Google Business Profile, and for everything published from your account, including anything published automatically under settings you enable. You are responsible for the accuracy and legality of your business information, reviews responses, and posts.

Acceptable use

• Do not use Presence to post deceptive, unlawful, harassing, or policy-violating content, or to manipulate reviews in violation of Google’s policies (for example, incentivized or fake reviews).
• Do not attempt to disrupt, reverse engineer, or misuse the service.
• Do not use Presence to manage profiles you are not authorized to manage.

Subscription and billing

• Presence is a paid subscription, currently $29 per month per location. The current price is always shown at signup.
• New accounts start with a 14-day free trial. If you do not cancel before the trial ends, your paid subscription begins automatically.
• Subscriptions are billed monthly in advance and renew automatically each month until you cancel. Payments are processed by Stripe.
• You can cancel at any time. Cancellation takes effect at the end of your current billing period, and you keep access until then.
• Fees are non-refundable except where required by law. We do not refund partial billing periods.
• We may change pricing with reasonable advance notice. Changes take effect on your next billing period.

Availability and changes

We work to keep Presence available and accurate, but the service depends on third-party APIs, including Google, that we do not control. We may modify or discontinue features. Data from Google may be delayed or incomplete due to those APIs.

Disclaimers

Presence is provided “as is” without warranties of any kind. We do not guarantee any particular ranking, review outcome, or business result. Local search rankings depend on many factors outside our control.

Limitation of liability

To the fullest extent permitted by law, Sandhill Labs LLC will not be liable for indirect, incidental, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months before the claim.

Termination

You may stop using Presence and disconnect your Google account at any time. We may suspend or terminate access for violation of these Terms. On termination, the rights granted to you end and we will handle your data as described in the Privacy Policy.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.
